PLEASE NOTE

Occupancy Limits – The Tenant certifies the limitations of this dwelling have been carefully read as set forth in this Rental Agreement, INCLUDING LIMITATIONS ON THE NUMBER OF PERSONS PERMITTED TO OCCUPY THE PREMISES AND NOISE NUISANCE CONDITIONS, and agrees to abide by such limitations.  Tenant agrees that if such limitations are exceeded, the Property Owner shall have the right to cancel this agreement.  In the event it becomes necessary to cancel this agreement, as provided for in this clause, any money paid by Tenant will forfeit Tenant as liquidations damages.  MUST BE 25 YEARS OF AGE, OR OLDER TO SIGN AGREEMENT.  Exceptions will be made for children accompanying adults on a case-by-case basis.

Telephone Number at the rental house is (208) 543-6199.  Long Distance:  To make long distance phone calls from the above phone, we will bill you or charge your credit card.  Most cell phones do not work on the property.

 

  1. Security and Utility Deposit:  The Tenant is responsible for the care of the premises, appliances and furnishings and for any and all damage by negligent or wrongful acts caused by the Tenant or Tenants guest.  Tenant agrees that the Property Owner may deduct charges for any damages as well as any excess cleaning fees.  Security Deposits paid with lease payment will be refunded upon inspection and cleaning of the property no later that 7 days from date of departure, unless a claim for damages is made, in such case you will be advised of such by Registered Mail.  If you prefer, a MC/Visa credit card authorization can be taken at signing of lease for the amount of the security deposit and no charge will be processed if there is no damage.  NONE REQUIRED AT THIS TIME.
  2. Cancellation Policy:  The reservation deposit is refundable if cancelled 10 days prior to your scheduled arrival. 
  3. Kanaka Rapids Villa Cleaning:  Included in your rental fee, our housekeeping will clean once weekly and immediately after your departure.
  4. Your Cleaning Responsibilities:  It is your responsibility to maintain the home in a neat and clean condition throughout your stay.  Some cleaning supplies are left in the home for your use, however if they run out it is your responsibility to replace them.  Laundry facilities are provided for your convenience.  You will be charged extra for leaving excessive dirty laundry (e.g. more than one set of linens per bed).  It is also your responsibility to wash all dishes prior to departure.  Please use the large garbage cans outside the yard.
  5. Linens:  The house is equipped with an ample supply of linens, dinnerware, tableware, glassware, cookware and cooking utensils.  We ask that you DO NOT USE owner’s towels for any use outside the premises.  PLEASE bring your own towels for this use.  We do supply towels for the pool.  We also provide your beginning supplies of toilet paper, dish soap, laundry detergent, hand soap and garbage bags to get you started, however, they will not be re-supplied during your stay.
  6. No Smoking:  Any guest violating the no smoking violation will be subject to eviction with no refund of any kind.  Smoking includes all kinds of lighted materials to be inhaled, including cigarettes, cigars, pipes, etc.  Smoking is allowed outside the home and by the pool.  Ashtrays are provided in these areas.
  7. Pets:  Pets are NOT allowed, except those for medical needs of the Tenant or Guest.
  8. Vehicles:  No RV’s or Campers allowed (unless the RV is your only means of transportation, and it can not be hooked up to the house, and can not have anyone staying in it during your stay.
  9. Check-In:  You will receive by mail or e-mail access instructions and code upon full payment.
  10. Liability and Damage:  Tenant shall indemnify and hold Property Owner free and harmless from any and all liability, claims, loss, damage or expenses arising by reason of any injury, death or property damage sustained by any person including Tenant, Guest or Employee of Tenant where such injury, death or property damage is caused by a negligent or intentional act of Tenant or any Guest of Tenant.
  11. Noise/Nuisance:  Tenant shall not disturb neighbors with loud noise or music, or unlawful, unsafe or pollution causing behavior.  Should Tenant allow or participate in such behavior, Tenant will be evicted and forfeit the remainder of the rental fee and the security deposit. 
  12. Pool Rules:  Kanaka Rapids Villa is equipped with a private pool and requires that Tenant and Guests agree to follow these pool rules: (a) Use amenities at your own risk; NO LIFEGUARD IS ON DUTY and dial 911 for emergencies; (b) No diving from anyplace other that the diving board, running or reckless play allowed; (c) Shower before using the amenities; (d) Use all pool equipment for its intended purposes only; (e) No glass or glass containers around the amenities, plastic containers are provided; (f) Do not add any chemicals or other agents to the pool; (g) Anyone with health problems or a condition (such as high blood pressure or pregnancy) prohibiting use should be aware and consult a physician prior to use; (h) Drink responsibly around the amenities; (i) Use of the amenities is limited to the actual leased occupants and guests of the home (j) Unsanitary condition(s) resulting from Guest’s use requiring drastic measures such as water replacement, shock treatment, etc. is at Guest’s expense and indulgence for time to return amenity usable; (k) Call Property Manager for service and do not attempt to operate any pool equipment including pump, vacuum, etc.
  13. Owner’s Storage:  Tenant understands that certain areas of the rental unit are reserved for the use of the Property Owner for storage of personal items, and are not for use by the Tenant and that Tenant may not force entry of such under penalty of trespass.
  14. Right of Entry:  The Property Owner or his employees shall have the right to enter the property at reasonable hours for the purpose of making repairs or inspections.
  15. Default by Tenant:  This agreement imposes an obligation of good faith in its performance and enforcement.  Tenant understands that upon violation of any conditions, agreements, restrictions, covenants, and obligations of the Rental Agreement, the Property Owner may terminate this Rental Agreement and enter the property by force or by statutory proceedings, in which case any and all moneys paid by the Tenant to the Property Owner will be forfeited by the Tenant as liquidated damages in addition to, but not in lieu of, any other right or remedy available under law.
  16. Rates:  Tenant acknowledges that rates are set by Property Owner and cannot be guaranteed for more than 6 months in advance.  In the event of a rate increase, Tenant will be notified not less that 6 months prior to arrival and will have the option of a full refund of deposits if the new rate is not agreeable to the tenant.
  17. SublettingSubletting is not permitted.  Tenants who sublet may be subject to fines of up to $250/day.

 

Statement:  I certify, under penalty of perjury, that I am 25 years of age, or older, and I am the holder of the credit card account referenced herein or have been authorized by card holder to make this reservation.  I fully understand and agree with all rental conditions from 1 to 17, listed on this agreement and the previous pages, and authorize Kanaka Rapids Villa to debit the initial deposit and other applicable charges from the credit card account written herein according the terms of this agreement.  In case of default by Tenant and non-collection by Kanaka Rapids Villa, guest agrees to pay for all court costs, Kanaka Rapids Villa attorney fees and all collections costs.

 

I understand this is a legally binding instrument.  Kanaka Rapids Villa will not share my personal information with third parties.  By providing the information herein, I hereby authorize Kanaka Rapids Villa to contact me for all purposes by all commercially reasonable methods.
